LuxSE PLUS: new document hyperlinking service under Prospectus Regulation

The Perma Link Upload Service - PLUS - is a new tool developed by the LuxSE to help issuers comply with their hyperlink obligations under the new prospectus regime. PLUS provides storage and access to issuers’ selected hyperlink for a period of 10+ years.

To comply with the hyperlink requirements of the new prospectus regime and lessen any ongoing monitoring which would need to be performed by issuers in this respect, the Luxembourg Stock Exchange (LuxSE) has recently built a new tool: the Perma Link Upload Service - PLUS.

According to the new Prospectus Regulation (EU) 2017/1129, applicable in Luxembourg since 21 July 2019, all documents incorporated by reference in a prospectus for public offers of securities and/or admission to trading of securities on a regulated market, must be accessible through hyperlinks pointing directly to the relevant document(s). These hyperlinks must be valid and accessible for at least 10 years.

It is therefore crucial for issuers to ensure that the hyperlinks remain operational during the entire lifetime of the prospectus.

PLUS allows issuers to fully comply with hyperlink obligations set out in the EU Prospectus Regulation. Indeed, PLUS guarantees that all hyperlinks included within a given prospectus will be valid and accessible for 10+ years. This is done by storing the documents within a segregated database in the LuxSE’s environment and establishing a unique hyperlink that points directly towards the relevant documents.

To obtain hyperlinks, the issuer must fill out and send to the LuxSE a special application form together with the relevant documents (via email : plusservices@bourse.lu.)

The LuxSE guarantees that the issuer will receive the requested hyperlink(s) within 24 hours. Fees per document submitted (max 50 Mb) amount to €150.
