Discounted premium and Wtp transition in the notarial profession: court dismisses claims by retired notaries

The District Court of The Hague has delivered its decision in extensive proceedings concerning the premium policy and transition plan of the Stichting Pensioenfonds Notariaat (SPN). Eight retired civil‑law notaries argued that they had been disproportionately disadvantaged for years due to the application of a discounted cost‑effective premium and the arrangements made under the Future of Pensions Act (Wtp), compared with active participants (current (candidate) notaries and other employees in the notarial profession). The subdistrict court did not follow this line of argument and dismissed all claims.

The judgment is significant for pension funds and social partners preparing for the Wtp transition, particularly with respect to premium smoothing, balancing the interests of stakeholders and providing compensation to active participants.
