Sidney Berendsen

  • Attorney at law
  • Partner

Sidney Berendsen, attorney at law, is a specialist in corporate law disputes, such as disputes involving M&A transactions, disputes between shareholders, proceedings with the Enterprise Chamber of the Court of Appeals and directors’ and supervisors’ liability. Next to this, Sidney is the head of the Corporate Investigations Team and has an extensive experience in this field, including inter alia:

  • Conducting internal investigations;
  • Negotiations with and/or proceedings against authorities and liable parties, including seizures and recovery of damages; and
  • Compliance related (pro-active) advice.

For example, Sidney is advising Rabo Vastgoedgroep - a subsidiary of Rabobank Netherlands - in the biggest fraud case ever tried in the Netherlands (the so called Vastgoedfraude). Rabo Vastgoedgroep and Philips Pension Fund incurred damages of hundreds of millions of euros. The mastermind of this fraud - and the members of his criminal organization - have been convicted for fraud, money laundering and bribery. In this case, Sidney and his team conducted internal investigations, levied numerous attachments against the offenders, negotiated many tri partite settlements with the perpetrators and the Public Prosecution Service and started civil proceedings against perpetrators, all in order to 'secure' the position of the client and recover its damages.

What others say about Sidney

Chambers: “Sidney advises on a broad range of contentious work, including shareholder disputes, directors' and officers' liability matters, as well as corporate fraud. He recently acted for Rabobank on a EUR63 million investigation into alleged misconduct within its subsidiary FGH Bank. Commentators hail him as a "practical lawyer who keeps a view of the bigger picture and is a very amicable guy to work with."
