Michael Daemgen is the Luxembourg-based lead partner of our fund regulatory team. Michael’s practice focusses on licence applications and ongoing regulatory support for alternative investment fund managers (AIFM). Michael works within a highly experienced regulatory team of lawyers based across multiple offices, enabling seamless support for an international client base and effective coverage of different time zones.
When it comes to regulatory support, Michael’s team focuses on matters such as on-site inspections by regulators, regulatory hygiene check-ups, mock inspections, gap analysis and remediation efforts. Michael has a unique skill set as he is a lawyer with strong consultancy background. As such he is not only able to navigate his clients on legal matters, but also able to provide them with more strategic advice when it e.g. comes approaching the Luxembourg regulator (CSSF), staffing of AIFMS and the launch of foreign AIFM branch offices. Michael's team is also recognised for its advice on the regulatory aspects of distribution and fundraising matters within and beyond the EU.
As Michael is closely integrated within our cross-disciplinary fund formation team, he has an outstanding eye for, for example, tax, employment law and structuring matters relevant to AIFM licence application process and ongoing maintenance, and his integration makes him ideally positioned to call on our specialists when needed. Because our fund regulatory team works closely with our financial regulatory team, clients benefit from top-tier services in both areas.
Michael organises the Regulatory Watch and Update Series and manages our Regulatory Snippet Series, ensuring that our clients are kept informed of new regulatory developments and legal matters that require their ongoing attention. Michael has also authored our Q&A for US and EU fund managers considering launching a Luxembourg AIFM.
