The Netherlands continues to maintain an open investment climate while applying greater scrutiny to investments that may affect national security. The chapter explores what this means in practice, addressing key topics including:
- when the Dutch FDI regime applies;
- which transactions and sectors may trigger notification requirements;
- how the notification and review process works;
- applicable review timelines; and
- the potential consequences of failing to notify a transaction.
The chapter also considers the evolving scope of the Dutch regime. From 1 January 2027, additional technology areas will be designated under the framework, including certain biotechnology, artificial intelligence, advanced materials and nanotechnology, sensor and navigation technology, and nuclear technology for medical applications.
