As from 1 January 2018 expansion of recognised measures concerning energy saving
Pursuant to Article 2.15 of the Activities (Environmental Management) Decree any party operating an establishment with an energy consumption that exceeds 25,000 m3 of gas per year or 50,000 kWh per year must take all energy-saving measures with a payback period of five years or less.
This stipulation often results in obligations for property owners and it is by no means always clear exactly which measures must be taken to comply with Article 2.15. In order to deal with this lack of clarity appendix 10 of the Environmental Management (Activities) Regulations provides a list with so-called 'recognised measures'. For more information about these recognised measures please refer to our previous news item of 31 July 2017. Both the recognised measures and the branches of industry that can rely on the list are expanded on a frequent basis.
Expanded list of recognised measures
On 1 January 2018 the list of recognised measures was expanded once again (Government Gazette 2017, 69337). Seven branches of industry were added to appendix 10:
- printing businesses
- paper and cardboard
- construction materials
- paint and printing ink
- filling stations and car wash establishments
- furniture and wood
- industrial units and retail trade.
New recognised measure 'energy registration and monitoring system'
In addition to this the new recognised measure 'energy registration and monitoring system' (ERMS) came into force on 1 January 2018 for six branches of industry. The branches in question are:
- healthcare institutions and welfare organisations
- educational institutions
- sports and recreation
- hotels and restaurants
- retail trade
An ERMS system shows the current consumption, the consumption rate throughout the day and how energy can be saved using smarter settings. A smart meter is sufficient in case of an energy consumption of 25,000 m3 up to 75,000 m3 of natural gas per year. If the energy consumption exceeds 25,000 m3 an ERMS system can consist of a building management system or other equipment in combination with meters and submeters that monitor the total or specific consumption.
