The most common type of matters that we handle are related to complex commercial and contractual disputes – for example, the delivery of defective goods under a purchase agreement, significant delays under a construction agreement, or unpaid bills. You can rely on our Commercial Litigation team to resolve any type of domestic or cross-border contractual dispute. We have a strong track record in enforcing judgments and awards, as well as in obtaining protective measures, such as freezing orders, and preliminary injunctions or resisting to them.
Insurance & Finance litigation
As a firm, we cover all legal, tax and regulatory expertise. This makes us ideally positioned to resolve business disputes that require specialist knowledge of the financial services sector: from complex finance litigations, to insurance coverage disputes, and disputes concerning liability of financial institutions. Our clients include financial institutions, insurance companies, insurance intermediairies, funds, private equity firms, venture capitalists, asset managers, and family offices.
Corporate litigation
Our corporate litigation experts have ample experience with all types of corporate disputes, for example:
- Shareholder disputes, and disputes between shareholders and management;
- Liability of the Management Board or supervisory board members;
- Inquiry proceedings and interim measures;
- M&A and post-M&A disputes, including breaches of representations and warranties under a share purchase agreement, as well as price adjustment issues; and
- Disputes related to shareholder agreements, joint venture agreements, and other corporate contracts.
We have substantial experience litigating cases before relevant courts in our home markets, including summary judges, district courts and courts of appeal, and more specifically the Enterprise Chamber of the Amsterdam Court of Appeal and commercial courts such as the Netherlands Commercial Court. We are also on top of key trends and developments with regard to activist campaigns and shareholder activism.
