On 17 March 2020, the law of 4 February 2020 containing Book 3 "Goods" of the Civil Code was published in the Belgian Official Gazette. With the new Book 3, the legislator wishes to better structure, modernise and integrate (the rules of) the law on goods into a single code. In addition, the legislator wants to create a functional, useful and flexible set of rules with a new - sometimes delicate - balance between freedom of contract and legal certainty.
Below you will find a general overview of the main thrusts of Book 3 and the most important changes that are being made.
