Tax litigation 


The tax litigation group consists of six members, all of whom are advocates. As such they are admitted to represent clients before all of the Dutch courts, and are well equipped to handle every aspect of tax controversies. Beside conflicts on substantive tax law, they deal collection issues, third-party liability for tax, international exchange of information, penalties and criminal prosecution for non-compliance. They further represent clients in civil law litigation and arbitration between private parties in which a tax issue is at stake.
 
We believe that tax litigation is conducted most effectively by lawyers whose practice focuses on tax controversy matters, and each member of the group devotes substantially all of his practice to handling potential or acute disputes. The experience of the members of the group not only enables them to take maximum advantage of the opportunities in a trial but also to well assess the risks of litigation.
 
The nestors of the group are Loek van Kaltmhout and Marten Mees. They have an impressive series of ground-breaking Supreme Court rulings to their name. Harold Asbreuk, Martien Pelinck and Annemarije Schoonbeek each have about 15 years of litigation experience, dealing with a broad variety of taxes and procedural issues and at all levels, including the Supreme Court an the EC Court of Justice.
