Energy (E&P)

Our Energy practice has advised on legal and tax matters for key players in the industry in the Netherlands for over 30 years. What sets our practice apart from the competition is that we are leaders in all main subsectors such as oil & gas (upstream, midstream and downstream activities), power plants and energy networks/distribution. Our combined tax and legal approach is highly valued by our clients. Our Energy practice also includes members from our Belgian and Luxembourg offices.

Our clients include large numbers of companies active in the Netherlands whom we advise on a continuous basis. We are involved in almost all M&A transactions in this sector and advise a substantial number of international energy groups on their international planning.

Key tax partners in our Energy practice are Waldo Kapoen and Wim Nan. They have advised on oil and gas tax issues for more than 20 years. They also advise energy companies with their international planning. Arnoud Viersen and Paul Simonis are leading advisers to energy producers gained name by negotiating opening balance statements when they were privatised. Over the years these four tax partners have built a strong reputation as the experts you want to bring in for complex tax issues. What sets us apart is our expertise on energy-related taxes and levies.

Max Oosterhuis, recognized as one of the leading energy lawyers in the Netherlands, is the leading legal partner who is also known as an ‘excellent energy litigator’. The team is supported by Henk Breeman who advises key clients in the field of zoning and environmental law. They advise several oil and gas companies with regard to CO2-emission rights. For the (project) financing, Willem Jarigsma and Kees Hooft are often involved. Kees has specialised on privatisation issues in the energy sector.Philip van Verschuer and Bas Vletter have built a strong name in M&A deals in the energy sector.

Unlike other law firms, we also provide tax compliance services and assistance with tax audits to oil and gas companies. Hans Zuiderbaan, a former Dutch state auditor with more than 20 years experience, heads the group providing these services.

Over the years, we have seen that energy companies are using the Benelux for tax and investment protection advantages. Waldo Kapoen and also other members of the Energy Team have been involved in a substantial number of structures and reorganisations combining these advantages assisted by Gerard Kreijen, a specialist on Bilateral Investment Treaties.

In all, we have more than 30 attorneys, tax lawyers and civil law notaries intensively involved with transactions and other developments within the energy sector. We have been involved in a number of the largest transactions in this sector and a wide range of dispute resolution and litigation cases.
