Loyens & Loeff announces the launch of its Asset Management Restructuring and Recovery Team 

The leading Benelux law firm Loyens & Loeff is building on its premier position in the area of asset & investment management, fund structuring and private equity transactions by adding an integrated team focussed on complex restructuring, insolvency and recovery situations for its clients in the asset management industry. The team will combine its extensive integrated corporate, finance, regulatory and tax experience with its sophisticated restructuring, insolvency and recovery expertise.

The team will be headed by Ilan Spinath, a leading international insolvency and restructuring specialist and Ronald Wijs, one of the premier tax lawyers in the fund structuring market. The team consists of 6 partners and more than 15 senior lawyers.

Loyens & Loeff is the first law firm to announce the formation of a dedicated Asset Management Restructuring and Recovery Team in response to and in anticipation of the effects of current financial crisis on the asset management industry. Its unrivalled expertise in the sector will enable the team to be a close advisor and lead counsel to investor groups in asset management funds that are affected by the crisis as well as to the asset managers themselves. The team will assist and provide practical and workable solutions to institutional investors, lenders, hedge funds, private equity- and real estate funds, distressed funds and asset managers in respect of a wide range of topics, including: fraud prevention, recalls of capital commitments, structured investment products, breaches in covenants of fund -and finance documentation, due diligence and quick scans on fund managers and investment opportunities, analysis of investment and risk control frameworks and finally the development of and advice on governance and codes of conduct against the backdrop of the challenges lenders, investors and managers will face as a result of the increased regulatory environment and enhanced supervision from regulators.
